WICHITA, Kan. (AP) - Prosecutors oppose a change of venue for the trial of the man charged in the shooting death of Dr. George Tiller. They say attorneys for Scott Roeder have offered no evidence to support their request. The defense argues potential jurors have been subject to vast pretrial publicity. A Dec. 22 hearing has been set on the issue.

TOPEKA, Kan. (AP) - The Kansas Supreme Court has upheld the capital murder conviction and 50-year sentence of a swimming pool maintenance man in the 2002 killing of a college student. But the court threw out Benjamin Appleby's separate sentence for the attempted rape of the woman. The court says it amounted to double jeopardy, since attempted rape was an element of the capital murder charge.

OVERLAND PARK, Kan. (AP) - Former U.S. Attorney General John Ashcroft has endorsed fellow Republican Todd Tiahrt's (TEE-hart's) U.S. Senate campaign. Tiahrt, a congressman, is running against Rep. Jerry Moran for the Republican Senate nomination.

TOPEKA, Kan. (AP) - Kansas officials say a 75-year-old man from the Topeka area has died of swine flu. Health officials say the man had underlying health conditions putting him at greater risk from the H1N1 virus. His death brings to 19 the state's total deaths related to the illness.
