Federal charges filed against man accused of murder and attempting to rob a Miami, Okla. bank

Updated April 11, 2014:  Francis Dishmon, of Tulsa, is now federally charged with attempted bank robbery, and killing a person while attempting to avoid apprehension.

Dishmon is accused of trying to rob the IBC Bank in Miami, Oklahoma in August 2013, then fleeing north out of town, where he caused a semi-truck and another vehicle to run off the road.

The driver of the semi-truck, James Wivell, 48 of Longmont, Colorado was killed in the crash.

Dishmon fled the crash site on foot and investigators found him hiding nearby.

Dishmon had previously been charged with murder at the state level.  Those charges were dropped once he was taken into federal custody.


Updated August 29, 2013 at 5:10 PM CST:  First degree murder charges are filed for a man accused of causing a deadly crash while fleeing an attempted bank robbery.

Francis Dishmon, 51, of Tulsa, Oklahoma was arrested in Ottawa County on Thursday afternoon.

Authorities say he had tried unsuccessfully to rob the IBC Bank in Miami on Thursday morning, then fled north out of town on U.S. Highway 69 at speeds of more than 100 miles an hour.

They say he caused a semi-truck and another vehicle to run off the road.

The murder charge is for the death of the truck driver killed in the crash.  That driver has been identified as James Wivell, 48 of Longmont, Colorado.

After the crash, Dishmon left his car and investigators found him hiding nearby.

Dishmon has not yet been charged with the attempted robbery in Miami.

An official with the FBI says as of right now federal charges will not be brought against Dishmon, but that could change.

Updated August 29, 2013 at 11:20 AM:  Authorities have identified the driver of the tractor trailer killed in a crash in Wednesday's high speed chase.

James Carl Wivell, 48 of Longmount, Colorado, died when his vehicle was struck by a vehicle driven by Francis Harry Dishmon, 51 of Tulsa.

Dishmon faces charges of False Personation and 1st Degree Murder, and more may be filed.

Dishmon was scheduled to appear in court this morning.

Updated August 28, 2013 at 5:15 PM:  Authorities arrest a suspect in Northeast Oklahoma following an attempted robbery, high speed chase and deadly crash. The series of events began this morning in Miami, Oklahoma, and ended near the Kansas state line.

Debris, flashing lights and the apprehension of a suspect wanted for homicide. This is how an attempted bank robbery ended in Ottawa County, Oklahoma on Wednesday. 

"Well it was a little bit of a shock, we don't get a lot of bank robberies," said Thomas Anderson, Acting Chief of the Miami Police Department.  

Miami P. D. say it all started sometime after 10am When Francis Harry Dishmon walked into an IBC bank in Miami and asked for money. Police say Dishmon likely got scared and left the scene, driving North on Highway 69-with no money in hand. 

"There was no weapon brandished at all, he handed the teller a note," Anderson said. 

It was on Highway 69 between Baxter Springs and Quapaw where authorities say Dishmon ran a semi-truck and second vehicle off of the highway while trying escape at speeds of 100 miles per hour. The driver of the semi-truck was killed.

"Well our first response is, since someone lost their life in this, were going to try to set up a perimeter and get the suspect apprehended," said Oklahoma Highway Patrol Trooper Ben Bertram.  

According to Oklahoma Highway Patrol, the suspect  ran from his vehicle only about a hundred yards down a ditch on the side of Highway 69. He was able to cover himself in brush, and hide from police for about two hours.

"There was over brush, and he was covered up in that, we had to call for assistance of the Oklahoma Highway Patrol airplane and they were able to spot him from the air," Anderson said.

Hidden, but not long. Police found and arrested Dishmon around 12:20pm-about two hours after the whole ordeal began.

Dishmon is currently being held at the Ottawa County Jail. Police say they will continue to follow up on the investigation, but that it will be up to the Ottawa County District Attorney to bring up final charges on Dishmon.
Updated August 28, 2013 at 3:55 PM:  Authorities say the name of the suspect in today's bank robbery is Francis Harry Dishmon.

The identity of the truck driver killed in the crash following the robbery still has yet to be released.

Updated August 28, 2013 at 1:00 PM:  One man is dead after an attempted bank robber crashed into another vehicle, killing the other driver.  The suspect is in custody and the incident is now being considered a homicide investigation.


Authorities say there was an attempted bank robbery this morning at IBC Bank in Miami, Oklahoma.  The suspect fled, traveling north along U.S. Highway 69, leading to a crash between Quapaw and Baxter Springs, Kansas.

The Oklahoma Highway Patrol confirms one death - a semi-truck driver involved in the crash.

The suspect has been identified as Desmond Francis Francis Harry Dishmon and is in custody.

Updated August 28, 2013 at 12:25 PM: The suspect in the Miami, Oklahoma attempted bank robbery and homicide on Highway 69 between Quapaw and Baxter Springs is a black male with long dreadlocks, 5'8", he is wearing and a blue plaid shirt.

He was last seen on foot in the same area as the crash.

Information according to the Wyandotte Police Chief.

Updated August 28, 2013 at 12:00 PM:  Due to the fatal crash, OHP says they are now treating the incident as a homicide investigation.

Updated August 28, 2013 at 11:40 AM:  The Oklahoma Highway Patrol has confirmed one death related to today's bank robbery and chase.  They say the driver of a tractor trailer involved in a crash with suspect has died.

Traffic is currently backed up on U.S. Highway 69 between Quapaw, Oklahoma and Baxter Springs, Kansas.

Updated August 28, 2013 at 11:08 AM:  Reporter Liz Holliday says officials tell her the IBC Bank was robbed this morning.  Authorities say the police chased the suspect, leading to a crash between Quapaw and Baxter Springs.

The suspect is still at large.

More information will be posted as it is confirmed.
