Candidate's name removed from Vernon County Ballot

Vernon County (MO) - The name of the Republican nominee for prosecuting attourney must be taken off the ballot. The judge ruled Dustin Dunfield doesn't qualify as a candidate because of a statutory rape conviction 18 years ago in Vernon County case. Dunfield had filed a seperate petition to get the conviction from 1996 set aside but a judge denied it. The county Republican Committee can nominate a replacement by October 1st.

Excerpts from the Judgement on the Pleadings:

"that contestee (Dunfield) was found guilty on December 13, 1996, of the class "C" felony of statutory rape."

That on August 29, 2014, this court heard a contested hearing between the parties in Cedar County.

At the conclusion of the hearing, court having taken judicial notice of State vs Dunfield  denied Dunfield's motion to set aside the plea of guilty.

As a result of the court's findings, that contestee has been found guilty in the State of Missouri of a felony, this court declares contestee Dunfield ineligible as a candidate for Vernon as a candidate for Vernon County Prosecuting Attorney.

Court hereby orders that Dustin W. Dunfield be disqualified as a candidate for Vernon County Prosecuting Attorney and the County Clerk is ordered to remove his name from the ballot of November 4, 2014.
