Same-sex marriage licenses will now be issued in Cherokee, Crawford and Labette counties

Same-sex marriage licenses will now be issued in Cherokee, Crawford and Labette counties.

An order directing county clerks to issue the licenses was given by the Chief Judge of the Kansas 11th Judicial District and became effective yesterday.

Chief Judge A.J Wachter's order reads, "All applicants for marriage licenses made by same-sex couples shall be issued and approved if the application otherwise meets the statutory requirements of Kansas."

The order comes in light of a current federal lawsuit underway, which challenges the state's gay marriage ban.

District court administrator Mac Young says the process of obtaining a marriage license in his district will now be the same for everyone.

"Anyone can come in and get an application for a marriage license," Young said. "They take that and fill out the required information and then they bring that application back.  There is a three day waiting period, and then the clerk will issue a marriage license at that time."

There is also a requirement for scheduling a ceremony.

"If the actual ceremony or wedding does not occur within six months, then the parties have to reapply," Young said.

Currently, two same-sex couples have applied for a marriage license in the 11th Judicial District.

Wachter says allowing those to be issued follows precedent established by the November 4 ruling at the United States District Court of Kansas, in which it was held that the right of same-sex couples to marry is a fundamental right protected by the U.S. Constitution. 

The Chief Judge for Butler, Elk and Greenwood counties argues his district will deny marriage licenses for same-sex couples.

The court administrator for Saline and Ottawa counties says they will accept same-sex marriage applications, but will not approve them until the Kansas Supreme Court reaches a final decision.
