New Motions Filed Attempting to Overturn $1.4 Million Dollar Judgment Against Wallace Bajjali


  New motions from attorneys for the now defunct Wallace Bajjali Development Partners contend the city of Joplin is partly to blame for the developers failures.
Attorneys filed a motion this week asking the court to overturn,  a one-point-four million dollar default judgment against Wallace Bajjali Development Partners.
The motion cites there is "good cause" to throw out the judgment because the partnership was not legally served notice of the lawsuit.
 In May, Judge Gayle Crane granted the city the one point four million dollar default judgment when there was no response to a lawsuit. 
  The current motion notes that  "CT Corporation"  was no longer  Wallace Bajjali's agent with the state when it was sent the summons.      
    Attorneys say "CT Corporation" sent the summons back to the city saying it didn't have a forwarding address for Wallace Bajjali. 
     In June Costa Bajjali's  attorneys filed a motion for a new trail but that motion was denied and a judgment against the firm was entered. 
     The current motion also claims the city violated exclusivity clauses giving projects away and impeding the developers future performance.  
     And that  the city of Joplin and Joplin Redevelopment Corporation owe Wallace Bajjali development pursuit costs.
