Details of Newton County Prosecutor car accident released

1/25/2016: According to MHP, Vehicle 1, driven by Kathleen Miller, was northbound on I-49 in the left lane. According to witnesses, Vehicle 1 nearly hit the front of their car when Miller lost control, and crossed over into the right lane. Miller's vehicle skidded off the roadway and struck a guardrail face. The vehicle spun counter-clockwise and struck the guardrail a 2nd time. Vehicle 1 continued northbound and struck the side of bridge. V1 came to rest partially on the shoulder, and in the northbound passing lane facing south. 

The report states that Miller did not have proof of insurance, and potential contributing circumstances were:

  • Alcohol
  • Improper Lane Usage/Change
  • Distracted/Inattentive

After the accident, MHP asked Miller to take a breathalyzer test. She refused, and was notified by Dept. of Revenue that her right to operate a motor vehicle would be revoked for a year effective January 1, 2016.  

Miller is trying to reinstate her driving license. She has filed a petition against the Dept. of Revenue. The petition was filed because: 

  • She was not informed her right to operate a motor vehicle would be revoked.
  • She also believes her rights were not read to her.

KOAM obtained the crash report under the Freedom Of Information Act.

1/8/2016: According to court documents, charges were filed yesterday (1/7/2016) for DWI.

According to the Missouri Highway Patrol, Newton County MO Assistant Prosecutor was arrested last week for a DWI charge.  The arrest happened last week Dec 17, 2015 at 2:25 PM in Jasper County. 

Kathleen Miller, 46, was released on her on her own recognizance.  According to MHP the Jasper County Prosecutor has the case.  No charges have been filed against the assistant prosecutor according court records. Due to the Holidays offices to both Newton and Jasper County prosecutors are closed.
