Motion Overruled In Wallace Bajjali Court Case

Update 8/16: According to court proceedings, the Jasper County judge ruled against Wallace Bajjali. In May 2016, the development firm asked for a previous judgement against them to set aside. The judge overruled the motion to set aside the $1.5 million default judgement against the company.

6/8: A court hearing scheduled for today for Joplin's former master developer is indefinitely put on hold.  An attorney for the City of Joplin says he needs more time to review new arguments from Costa Bajjali's attorney, filed May 24.

Last August in Joplin court, Bajjali motioned for a judge to get rid of a $1.5 million settlement against Wallace Bajjali, filed by the City of Joplin.  The motion was denied.

Joplin officially terminated its contract with Wallace Bajjali in February of last year, after the company folded and vacated its offices in Joplin and Sugarland, Texas.  But a new motion filed by Bajjali's attorney, Bill Fleischaker of Joplin, further contends Bajjali never received a court summons to previous hearings, and a company that used to legally represent Wallace Bajjali is at fault.

The new motion reads, in part, that the legal representative, known as CT, could have easily contacted Wallace Bajjali Development Partners about the process.

Costa's attorney also says his client's actions could have been negligent, not reckless or intentional.  The motion goes on to argue that even if reasonable doubt exists as to whether the conduct is intentional or negligent, the doubt should be resolved in favor of good faith.

A new court date has not yet been rescheduled for Costa Bajjali.  Fleischaker tells us he hopes to hear back from the City of Joplin's attorney, Karl Blanchard, within the next 30 days.
