Mistrial for 32 Year Old Murder Explained


A judge declares a mistrial in a Joplin murder trial. After being on the run for 30 years Paul Moses is back in Joplin standing trial for the murder of 62 yr. old Francis Ramsey. But before the second day of testimony could even begin the judge declared a mistrial. Earlier this morning public defender Larry Maples told the judge that while he was waiting to be called into the courtroom a bailiff asked him if Moses had been brought into the courtroom implying that he was being held in custody. The question was asked in earshot of some of the jury members who were to be in the dark on whether or not Moses was being held in custody in order to avoid any prejudices. Before the trial began the defense presented an oral motion for a mistrial that was eventually granted by the judge. The prosecution will have to start again from scratch, but judge David Mouton says a re-trial could happen as early as December.
