Second Degree Murder Case Dismissed in McDonald County, MO

The court dismisses a case against a woman accused in the death of a foster child.

Attorneys had charged Jessica Newhard with second degree murder in the death of 21-month-old Megan McCuller in McDonald County, MO.

In 2001, Newhard lived in Rocky Comfort in McDonald County. She and her husband were given custody of Megan. Newhard's husband was the child's uncle. At the time of Megan's injuries, Newhard was the only one with the girl. According to court documents, Newhard called her husband saying Megan was having a seizure. He arrived and called 911. The child later died at the hospital from head trauma. Newhard was arrested for felony child abuse, but the case was dismissed with the condition that it could be filed again later.

In 2014, court documents show that Newhard allegedly admitted to her now estranged husband that she killed Megan. Newhard was charged and accused of violently shaking and physically abusing the girl.

McDonald County Attorney Bill Dobbs says today, April 17th, 2018, the case was dismissed due to insufficient evidence to prosecute an old case.
