Bard Resigns After Temporary Suspension From Joplin Council

Update: Joshua Bard says he sent in a letter of resignation today (April 26th).  According to Bard, his attorney filed a motion to dismiss and he has submitted a letter of resignation.  Bard says he has already started the process of getting the charges expunged that prevented him from being on the council and that he will run for city council again in 2020.  He says he appreciates and is humbled by the support he's been getting. 

"I will be doing all that I can over the next year and a half to help our Police and Fire Departments. As well as, working to change the statutes that directly effect those that are trying to better themselves," said Bard.

A judge temporarily suspends Joshua Bard from being on the city council.

Bard, a newly elected Joplin City Council member, submitted his resignation in early April because of a previous drug conviction. He then reversed his decision to resign.

On April 24th, 2018, Jasper County Prosecutor Teresa Kinney filed a petition for a judge to decide the fate of Bard's council position. According to the "quo warranto" petition, Bard is suspended from council and has until May 25th to present his case. If Bard does not make a case, the judge could rule that he is no longer able to perform his duties as a Joplin City Council member.

According to court documents, in December of 2017, Bard signed documentation stating that he is qualified and meets the requirements for the elected position. Shortly after Bard was sworn in on April 9th, 2018, City Attorney Peter Edwards was informed that Bard is a felon after being convicted in a 2005 case.

According to city code and state statue (RSMo Section 115.306), "No person shall qualify as a candidate for elective public office in the state of Missouri who has been found guilty to a felony or misdemeanor under the federal laws of the United States of America or to a felony under the laws of this state or an offense committed in another state that would be considered a felony in this state."
