Attorney for Man Accused of Shooting Jasper County Deputy Files Continuance

Updated:
Joplin, MO -

The defense attorney for E.F. Fitchpatrick, Jr. asked for a continuance today, November 5th, 2018. Fitchpatrick, Jr. is accused of shooting a Jasper County Sheriff's deputy leading to a standoff in Joplin, Missouri.

The shooting happened on March 1st, 2017. The Ozark Drug Enforcement Team was serving a warrant at the Econo Lodge on Range Line Road in Joplin. As officers tried to go in, a shot was fired and hit Jasper County, Deputy Nolan Murray. The bullet hit a part of Murray's chest that wasn't covered by the bullet-proof vest, went through his lung and lodged itself near his back. Dozens of officers, including SWAT, responded to the scene and evacuated the hotel. After a more than three hour standoff, Fitchpatrick, Jr. surrendered and was found with a self-inflicted gunshot wound to the face.

Fitchpatrick, Jr. underwent surgery and recovered at a hospital. He pleaded not guilty to charges of first-degree assault, armed criminal action and unlawful possession of a firearm.

On March 6th, Deputy Murray was released from Freeman Hospital. He had successful surgery to remove the bullet from his back.

Today, attorneys for Fitchpatrick filed a continuance. They told the court there is cellphone video they plan to use as evidence that needs to be "cleaned-up".
